RECOMMENDATION:
Recommendation Concerning a State of Florida, Division of Emergency Management State-Funded Grant Agreement - Michael D. Weaver, Public Safety Department Director

That the Board take the following action regarding the State-Funded Grant Agreement, Contract Number 18-BG-XX-01-27-01-XXX:

A. Approve the State of Florida, Division of Emergency Management (FDEM), State-Funded Grant Agreement Base Grant, providing funds in the amount of $105,806, to assist in enhancing the daily and emergency operations of the Escambia County Division of Emergency Management and to assist in the local disaster planning and community outreach efforts for the period July 1, 2017, through June 30, 2018;

B. Authorize the Chairman or Vice Chairman to execute the Grant Agreement; and

C. Authorize Michael D. Weaver, Public Safety Department Director, to execute and certify each Grant quarterly report, reimbursement request, Grant close-out report, and any subsequent document, as appropriate, to implement this Grant as follows:

"By signing this report, I certify to the best of my knowledge and belief that the report is true, complete, accurate, and the expenditures, disbursement and cash receipts are for the purposes and objectives set forth in the terms and conditions of the Federal award.  I am aware that any false, fictitious, or fraudulent information, or the omission of any material fact, may subject me to criminal, civil or administrative penalties for fraud, false statements, false claims or otherwise.  (U.S. Code Title 18, Section 1001 and Title 31, Sections 3729-3730 and 3801-3812)."

The County Attorney's Office has requested that the Board be made aware of the following language within the Agreement:

Section (21) Mandated Conditions, Subsection "B", that "This Agreement shall be construed under the laws of the State of Florida, and venue for any actions arising out of this Agreement shall be in the Circuit Court of Leon County."

BACKGROUND:
The State of Florida created the Emergency Management Preparedness Assistance Grant (EMPA) in 1993 to provide funding to local governments and other service organizations to improve disaster preparedness and public education.  This grant is providing funds in the amount of $105,806 for fiscal year 2017-2018, with a contract period of July 1, 2017 through June 30, 2018.
BUDGETARY IMPACT:
The grant funds are designed as an operational cost reimbursement to the Escambia County Division of Emergency Management with an indirect match requirement; "at the amount either equal to the average of the previous three years' level of county general revenue funding of the County Emergency Management Agency or the level of funding for the County Emergency Management Agency for the last fiscal year, whichever is lower."  "Recipient’s general revenue funding for 911 services, emergency medical services, law enforcement, criminal justice, public works, or other services outside of the local emergency management agency" as defined by Section 252.38, Florida Statutes, "shall not be included in determining the level of county funding of the Recipient’s Emergency Management Agency.”  
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Assistant County Attorney, has reviewed the Agreement and approved it as to form and legal sufficiency.
PERSONNEL:
N/A
POLICY/REQUIREMENT FOR BOARD ACTION:
Board of County Commissioners' Policies require grant agreements be approved by it. 
IMPLEMENTATION/COORDINATION:
John Dosh, Division of Emergency Management Manager, will oversee implementation upon approval of the Agreement.  This grant is being coordinated with the FDEM.
